Family court determines custody, parenting time and support, and those determinations shape daily life for years. Most of what happens in the courtroom is decided by how thoroughly the position is prepared before the hearing.
If the non-custodial parent will not contribute, a petition needs to be filed properly and early. We will tell you what your child is entitled to receive before you commit to anything, and the consultation costs nothing.
Family Court is concerned with the best interests of the child, not the convenience of either parent.
The law recognizes a substantial change in circumstances. If you cannot meet your current obligation, or if your children now require more than they receive, a petition for modification is available. Courts do not grant these lightly; the petitions that succeed are the ones that arrive fully documented.
Sometimes physical custody has to change. Substance abuse, neglect, unsafe conditions, or a child’s basic needs going unmet are all grounds to petition. We prepare the petition and we appear with you at the hearing.
A non-custodial parent has rights, and so does the child. Courts encourage children to have a relationship with both parents. If you are being denied access, or an existing schedule is being ignored, the petition to Nassau County Family Court is the remedy.
Common questions
In Family Court, judges are ordinarily concerned with what is in the best interest of the child, not the parents. The court can reduce an obligation where there is a substantial change in circumstances. We file the modification petition on your behalf.
An upward modification can be sought where the children’s needs have increased, where the cost of living has risen, or where the residential parent has lost income. A consultation will tell you whether you have a basis for one.
There are many reasons a court will order a change to custody, visitation, or both. Bring us the circumstances and we will tell you what the realistic recourse is.
If your child does not reside with you, you still have rights regarding your child. Parents have the right to visit with their children, and courts encourage children to have a relationship with both parents.
